Prsrve exists so the things you most want the people you love to have can reach them, even after you are gone. That is a serious promise, and these terms explain it plainly: what we provide, what it costs, how release to your readers works, and what we each agree to. Please read them. By creating an account or using prsrve.com, you agree to these terms.

Who we are
Prsrve is operated by [YOUR FULL LEGAL NAME], doing business as Prsrve, based in California, United States ("Prsrve", "we", "us"). You can reach us at care@prsrve.com.
What Prsrve is, and what it is not
Prsrve lets you preserve personal moments, including written stories, letters, photos, audio, and video, and designate the people who should receive them ("readers"). Preserved moments remain private until they are released through the process described in section 8, which happens only after a human review of proof that you have passed away. Prsrve never releases your moments on a timer, a date, or automatically.
Prsrve is not a will, trust, or estate-planning instrument, and nothing in the service is legal advice. Your moments are personal messages, not legally binding documents. Prsrve does not replace an estate plan, and designating a reader does not create any legal right to your property.
Your account
You must be at least 18 years old to use Prsrve. You agree to provide accurate information, keep your login credentials private, and tell us promptly if you believe your account has been accessed without your permission. You are responsible for activity on your account.
Plans and payment
You can create an account and preserve your first moment for free. Preserving more, and the full service, requires the Permanent Preserve: a one-time payment of $99 that includes 10 GB of permanent storage and your first year of active prsrve. After that year, active prsrve renews automatically at $29 per year and is only required to keep adding new moments. You can add 25 GB of permanent storage for $49 at any time, as many times as you like.
If you do not renew, everything you have already preserved stays, permanently, and your readers' access and the release process are unaffected. Non-payment never causes deletion.
Payments are processed by Stripe; we never see or store your card number. Renewal charges are made to your saved payment method. You agree to automatic renewal when you check the box at checkout, and we record the date you did. We will email you roughly 30 days before any renewal charge, telling you what is renewing, the exact date, the amount, and how to cancel. You can cancel auto-renewal at any time from Settings, Billing, in a few clicks and without contacting us. Prices may change, but changes apply only to future purchases and renewals, never retroactively, and we will give you at least 30 days' notice before a renewal price change affects you.
Refunds
Any charge is fully refundable within 30 days of that charge, no questions asked. Email care@prsrve.com from your account email. After 30 days, charges are non-refundable.
Refunding the Permanent Preserve returns your account to the free plan, which holds one preserved moment. We will ask you which moment to keep. Your other preserved moments return to drafts, remain in your account for 30 days from the refund so you can export them, and are then permanently deleted. Refunding a $29 renewal ends Active Prsrve for that year; nothing already preserved is removed. Refunding a $49 storage add-on removes that storage from your allowance.
Your content
Everything you preserve belongs to you. You grant us only the limited license needed to operate the service: to store your moments, back them up, process them (for example, generating a preview or streaming a video), and display them to you and, after release, to the readers you designated. We do not sell your content, use it for advertising, or use it to train artificial intelligence models.
You are responsible for what you preserve. You agree that you have the rights to the material you upload and that you will not use Prsrve to store or transmit anything unlawful, or content that infringes someone else's rights.
The people you add
When you add a person and their email address, you confirm you have a genuine personal relationship with them and their information is accurate. We use readers' contact information only to send the notifications you initiate and to operate the release process, never for marketing. A person you designate can decline; if they do, we honor that and stop contacting them.
Release to your readers
This is the heart of Prsrve, so here is exactly how it works. Your moments are released to a reader only after (a) someone requests access through the reader's private link, (b) they provide proof of your passing, such as a death certificate, an obituary, or comparable documentation, and (c) a human reviewer at Prsrve examines that proof and approves the release. We may request additional documentation, and we may decline a request we cannot verify.
We aim to review requests promptly, ordinarily within 14 days of receiving sufficient documentation, but we cannot guarantee a specific timeline. If we receive conflicting claims, credible evidence of fraud, or notice of a legal dispute concerning a release, we may pause the process until it is resolved, and we may comply with valid court orders. Released moments are made available to designated readers for viewing; readers receive access to your moments, not ownership of your account.
What "permanent" means
We promise to keep your preserved moments stored, backed up, and available for the life of the service, regardless of whether you continue to pay for active prsrve. We take that seriously: redundant storage, backups, and no deletion for non-payment, inactivity, or death.
We also owe you honesty about the limits of any promise made by a service. If Prsrve ever had to wind down, we would give you at least 12 months' notice at your account email and provide a way to export everything you have preserved before anything is removed. Where reasonably possible we would seek to transfer the preservation commitment to a successor rather than shut down.
Acceptable use
Do not use Prsrve to harass or defame others, to store unlawful content, to impersonate someone, to submit falsified documentation in the release process, to probe or disrupt our systems, or to violate any law. We may suspend or terminate accounts that do, and in cases of fraud in the release process we may notify authorities.
Closing your account
You can delete your account and everything in it at any time by emailing care@prsrve.com from your account email. Deletion is permanent and includes your preserved moments, so we will confirm before acting. We may terminate accounts that materially violate these terms; if we do, we will say why and, except in cases of fraud or unlawful content, give you an opportunity to export your moments.
Service changes
We improve Prsrve continuously and may change features over time. We will not remove your ability to access what you have preserved, and material changes to the release process will be communicated to you in advance.
Disclaimers
Prsrve is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that any particular release request will be approved.
Limitation of liability
To the fullest extent permitted by law, Prsrve will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, and our total liability for any claim arising out of the service is limited to the greater of the amounts you paid us in the 12 months before the claim or $100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Indemnification
You agree to indemnify and hold us harmless from claims arising out of your content, your violation of these terms, or your violation of another person's rights, including claims by or disputes among your readers or family members concerning content you chose to preserve or designate.
Governing law and disputes
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us and give us 30 days to try to resolve the issue informally. Disputes that cannot be resolved informally will be brought in the state or federal courts located in California, and both sides consent to their jurisdiction. Either party may bring a qualifying claim in small claims court instead.
Changes to these terms
If we change these terms materially, we will email you at your account email at least 30 days before the changes take effect. Continuing to use Prsrve after that date means you accept the updated terms. The "Last updated" date above always reflects the current version.
